1. WHO WE ARE

This website, www.bestlearning.com (the "Site"), is operated by BEST LEARNING MATERIALS CORP., a company registered in Taiwan, with its registered office at 9F, 303 Fuxing North Road, 10544 Taipei City, Taiwan.

Throughout the Site, "we", "us" and "our" refer to BEST LEARNING MATERIALS CORP. You can contact us at info@bestlearning.com.

2. AGREEMENT TO THESE TERMS

By visiting the Site or buying something from us, you agree to these Terms of Service, including any additional terms and policies referenced here or available by hyperlink. These terms apply to all users of the Site, including browsers, customers, and contributors of content.

If you do not agree to these terms, please do not use the Site.

We may update these terms at any time by posting a revised version on this page. The "last updated" date above tells you when the current version took effect. Continuing to use the Site after a change means you accept the revised terms. Changes do not apply retroactively to orders already placed.

3. ELIGIBILITY

You must be at least the age of majority in your place of residence to purchase from the Site. The Site is intended for use by adults. Our products are designed for children, but they are sold to adults.

You may not use our products or the Site for any unlawful purpose, or in breach of any law that applies to you.

4. PRODUCTS

We make reasonable efforts to display product colours and images accurately, but we cannot guarantee that your screen displays them exactly. Product packaging and accessories may vary from images shown.

Products are subject to availability. We may limit quantities, discontinue a product, or restrict availability by region at any time.

Please follow the age guidance and safety warnings on the product packaging and instructions.

5. ORDERS AND PRICING

All prices on the Site are shown and charged in [US dollars], regardless of where you are ordering from. The full amount payable is shown at checkout before you pay, and we will not charge you more than that total.

If your payment card or bank account is held in another currency, your card issuer or bank will convert the amount at their own exchange rate and may apply their own fees. They set those charges, not us, and they aren't included in the total shown at checkout.

Placing an order is an offer to buy. We accept your order when we send you an order confirmation email. We may refuse or cancel an order, including after confirmation, if the product is unavailable, if there is an error in the price or description, or if we suspect fraud or a breach of these terms. If we cancel a paid order, we will refund you in full.

We try to keep product and pricing information accurate, but errors occur. Where an error is obvious and could reasonably have been recognised as an error, we are not obliged to supply the product at the incorrect price.

6. RETURNS

Products may be returned in accordance with our Return and Refund Policy. Please read it before ordering.

7. SHIPPING

Delivery destinations, timings, and costs are set out in our Shipping Policy.

8. PAYMENT

You confirm that you are authorised to use the payment method you provide, and that the information you give us is accurate and complete.

Payments are processed by our payment providers. We do not receive or store your full card details. See our Privacy Policy for how your information is handled.

We also offer express checkout methods at checkout. If you use one, your payment is handled by that provider under its own terms and privacy policy. Choosing to save your details for a faster checkout creates an account with that provider, governed by their terms rather than ours.

9. YOUR ACCOUNT

If you create an account, you are responsible for keeping your password confidential and for activity under your account. Tell us promptly at info@bestlearning.com if you believe your account has been used without your authorisation.

10. ACCEPTABLE USE

You agree not to use the Site to break any law, infringe anyone's intellectual property, transmit malicious code, collect others' personal information, send unsolicited commercial messages, interfere with the Site's security, or scrape the Site by automated means without our written permission.

We may terminate your access for breach of this section.

11. INTELLECTUAL PROPERTY

The Site and its content — including text, product descriptions, images, illustrations, characters, logos, and the BEST LEARNING name — are owned by us or our licensors and protected by intellectual property law. You may not copy, reproduce, or use them commercially without our written permission.

12. CONTENT YOU SUBMIT

If you send us reviews, photographs, comments, product ideas, or other material, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it in connection with our business. You confirm the content is yours to give and does not breach anyone's rights.

We may, but are not obliged to, monitor, edit, or remove submitted content. We are not obliged to keep any submission confidential, to pay for it, or to respond to it.

13. THIRD-PARTY LINKS

The Site may link to third-party websites and services that we do not control. We are not responsible for their content, products, or privacy practices. Your dealings with them are between you and them.

14. DISCLAIMERS AND LIMITATION OF LIABILITY

We provide the Site and our products with reasonable care and skill. To the fullest extent permitted by law, and subject to the paragraph immediately below, we exclude implied warranties and conditions, and our total liability arising out of or in connection with your use of the Site or any product is limited to the amount you paid for the product concerned.

Your statutory rights. Nothing in these terms excludes or limits any right you have that cannot be excluded or limited by law, including:

Australia. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality, and the failure does not amount to a major failure.
United Kingdom. Your rights under the Consumer Rights Act 2015 are unaffected.
United States and Canada. Your rights under the consumer protection law of your state or province are unaffected.

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

15. INDEMNITY

You agree to indemnify us against claims arising from your breach of these terms or your violation of any law or third-party right.

16. SEVERABILITY

If any provision of these terms is found unenforceable, it is severed to the minimum extent necessary, and the remaining provisions continue in force.

17. GOVERNING LAW

These terms are governed by the laws of Taiwan, and the courts of Taiwan have jurisdiction.

This does not deprive you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in your local courts where that law gives you that right.
